Pursuant to CFTC Regulation Section 1.55
Engaging in trading commodity futures, securities, and forex involves a high degree of risk. It is crucial to evaluate whether such trading aligns with your financial circumstances, resources, and risk tolerance. You should be aware of the following points:
- Total Loss of Funds: You may sustain a total loss of the funds that you deposit with your broker to establish or maintain a position in commodity futures, forex, or securities markets. You may incur losses beyond these amounts. If the market moves against your position, you may be called upon by your broker to deposit a substantial amount of additional margin funds on short notice to maintain your position. Your use of FrontierAlgo constitutes your acceptance of these Terms and Conditions, our Privacy Policy, and all applicable disclaimers. We reserve the right to modify these terms at any time. Continued use of our services following any changes constitutes your acceptance of such changes.
User Responsibilities
As a user of FrontierAlgo, you agree to:
- Use our products and services solely for your personal, non-commercial trading activities
- Use our Software Products only on your own computer(s) and TradingView account(s)
- Not distribute, share, sublicense, or otherwise make available our products, signals, or source code to any third party
- Not reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without express written permission
- Not attempt to reverse engineer, decompile, or disassemble any software or tools provided
- Maintain the confidentiality of your account credentials
- Comply with all applicable laws and regulations
Prohibited Activities
You expressly agree NOT to:
- Distribute trade signals generated by our software to any third party
- Allow others to copy trades based on our software output
- Grant rights to use our Software Source Code or Software Products to anyone else
- Use our services for any unlawful purpose
- Interfere with or disrupt our services or servers
Violation of these terms may result in immediate termination of your access and may subject you to legal action for damages incurred by Open Channel Media, LLC.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the State of Wyoming, without regard to conflicts of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in a federal or state court of competent jurisdiction located in the State of Wyoming. You consent to the personal jurisdiction of such courts.
Limitation Period
Any cause of action or claim you may have with respect to our services must be commenced within one (1) year after the claim or cause of action arises, or such claim or cause of action shall be permanently barred.
Waiver and Severability
The failure of Open Channel Media, LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Assignment
Open Channel Media, LLC may assign its rights and duties under this Agreement to any party at any time without notice to you. You may not assign or transfer your rights under this Agreement without our prior written consent.
Confidentiality Agreement
By subscribing to FrontierAlgo, you enter into a mutual confidentiality agreement with Open Channel Media, LLC. This agreement protects proprietary information that we share with you.
Definition of Confidential Information
"Confidential Information" encompasses:
- Our unique trading tools and indicators offered on the TradingView platform
- Our software products ("Software Products")
- Trading signals and visual outputs generated by our software
- Our software source code ("Software Source Code")
- Documentation, user guides, and instructional materials
- Proprietary methodologies and algorithms
- All correspondence and communications
Exclusions from Confidential Information
Confidential Information does not include:
- Information that is or becomes publicly available through no fault of yours
- Information that was rightfully in your possession prior to disclosure by us
- Information that is independently developed by you without use of our Confidential Information
- Common programming practices or publicly available algorithms
Your Obligations
You agree to:
- Treat all Confidential Information with the same degree of care you use to protect your own confidential information, but in no event less than reasonable care
- Not disclose Confidential Information to any third party without our prior written consent
- Use Confidential Information solely for your personal trading activities
- Take all reasonable steps to prevent unauthorized disclosure or use
